Freedom of Information Act / Texas Public Information Act – Open Records Requests

PLEASE NOTE: Nacogdoches County Emergency Services District #2 (Nacogdoches Co. ESD #2) does not maintain 911 call data or traffic collision reports outside of a potential fire department response. If you need 911 call data, contact the Nacogdoches County Sheriff’s Office and request the Records Division. A. Submitting a Written Request

Persons desiring to inspect or copy records of the Nacogdoches County Emergency Services District #2 (Nacogdoches Co. ESD #2) may make a written request for the desired records to the Board Secretary. The request shall identify the specific record(s) being requested, as well as specific dates. In addition, it is preferable that the request identify the name, address, and phone number of the person requesting the information, so that the Nacogdoches Co. ESD #2 may contact the Requester with the response to the request. The Board’s Secretary shall ensure the request is marked with the date on which it was first received. An Open Records Request Form may be provided; but all written requests are acceptable.

B. Methods of Request and Review Process

Applications for the inspection of, or copying of records, may be made through the mail, email, or in person. The Board Secretary shall review the application with the appropriate department to determine the following:

  • Whether the record being requested exists;
  • Whether the record is available, in use, or in storage; and,
  • Whether the record is subject to disclosure under State, Federal, and local laws.

If a question exists as to whether the record is subject to disclosure, the record shall be referred to the Board’s Attorney for review.

C. Notification of Results

Upon completion of the review, the applicant shall be informed of the results of the review.

D. Costs / Deposits

The Requester shall receive written notice of actual estimated charges to the extent such notice is required by the Texas Public Information Act and the rules of the Texas Attorney General. A deposit in advance in accordance with the rules of the Texas Attorney General may be required.
